What is the Time Frame for Filing a Personal Injury Case?

Posted by: Personal Injury Attorney

What is the Time Frame for Filing a Personal Injury Case? Those that have recently been the victim of an accident may be unsure of where to turn in those first few hectic days or weeks. They may be undergoing medical treatment, be in physical pain, or even shock. On top of this, all of one’s injuries may not become apparent for months or even years down the road. This has led many victims to ask, what is the time frame for filing a personal injury case?

The body of the law that dictates how long a victim has to file a personal injury case is known as the statute of limitations. For most automobile accidents, and premise liability cases, the cutoff is 2 years. This is 2 full years from the date that the injury has been discovered.

There are exceptions to this rule that everyone should remain aware of though. The Discovery of Harm rule allows patients to file a personal injury claim at any point, even years later. This can only be done if the victim could have reasonably not known about the injury until that point. These types of cases are quite frequent, such as medications with severe side effects that may not harm a patient until much later on in their life.
